1. Privacy Policy

Who is responsible for this website

This website is operated by Peter Muscutt, a UK-based independent creator. For privacy questions, data requests, or concerns, please contact info@petermuscutt.com.

Personal information collected

Depending on how you use the site, petermuscutt.com may collect:

  • Order, basket, payment status, download, and shop-related details where those features are used.
  • Technical information such as IP address, browser user agent, browser language, page URL, referrer URL, and UTM campaign fields.
  • Cookie consent records, including your consent choices, consent version, consent ID, policy URLs, consent text hash, and timestamps.

How the information is used

Personal information is used only where there is a practical reason to do so, including:

  • To respond to enquiries sent through the contact form or by email.
  • To provide website features such as accounts, downloads, shop functions, and admin access.
  • To process orders, confirm payment status, provide download access, and handle support requests.
  • To record and respect cookie consent choices.
  • To maintain website security, prevent misuse, investigate errors, and protect accounts.
  • To understand how visitors use the website, where analytics cookies have been accepted.
  • To meet legal, accounting, tax, or regulatory obligations where applicable.

Payments and Stripe

Payments are processed securely through Stripe Checkout. petermuscutt.com does not store full card details on its own servers. Stripe may process payment information, fraud-prevention data, device data, and transaction details in accordance with Stripe's own terms and privacy notices.

Lawful bases

The lawful bases for processing may include:

  • Consent, for optional cookies and any optional communications you choose to receive.
  • Contract or steps before a contract, where you ask for services, downloads, purchases, or account access.
  • Legitimate interests, for website security, responding to enquiries, basic administration, fraud prevention, and improving the site.
  • Legal obligation, where records must be kept for tax, accounting, legal, or regulatory reasons.

Who information is shared with

Personal information is not sold. It may be shared with service providers only where needed to run the website or provide requested services, such as website hosting, database hosting, email delivery, payment processing, analytics services where accepted, and professional advisers where necessary.

Some external links on this website lead to third-party sites. Those sites have their own privacy and cookie practices.

How long information is kept

Information is kept only for as long as needed for the purpose for which it was collected. In general:

  • Contact enquiries are kept for as long as needed to respond and manage the enquiry.
  • Account and admin records are kept while the account is active and for a reasonable period afterwards.
  • Cookie consent records are normally kept for the life of the consent record, currently linked to a 365-day consent cookie unless refreshed or withdrawn.
  • Transaction records may be kept for longer where needed for tax, accounting, fraud prevention, chargeback handling, or legal reasons.

Your rights

Under UK data protection law, you may have rights to access, correct, erase, restrict, object to, or receive a copy of your personal information. Where processing is based on consent, you may withdraw that consent at any time.

To make a request, email info@petermuscutt.com. You also have the right to complain to the UK Information Commissioner's Office at ico.org.uk.

Security

Reasonable technical and organisational measures are used to protect personal information. No method of transmission or storage is completely secure, so absolute security cannot be guaranteed.

2. Cookie Policy

What cookies are

Cookies are small files or browser-held identifiers used by websites to remember information, keep features working, improve performance, and provide security features.

Cookie consent

petermuscutt.com uses a custom cookie consent system. Necessary cookies are used because the site cannot work properly without them. Optional categories are used only where you accept them.

The consent system stores a consent cookie called cookie_consent_id. It is currently set to last for 365 days. The website also stores a consent record in the database so that your choices can be recorded and respected.

Cookie categories

  • Necessary cookies: required for core site functions such as sessions, security, basket/cart features, admin login, account access, checkout, downloads, and remembering your cookie consent choice.
  • Analytics cookies: used to understand website usage and improve the site, only where accepted.
  • Preferences cookies: used to remember optional preferences, only where accepted.
  • Marketing cookies: reserved for marketing or advertising-related features, only where accepted.

Stripe and payment cookies

Payments are processed through Stripe Checkout. Stripe may use cookies or similar technologies for payment processing, fraud prevention, security monitoring, transaction verification, and remembering eligible checkout details. petermuscutt.com does not control Stripe's payment systems or cookies.

Third-party cookies

Some third-party services integrated into the website may place cookies on your device. These may include payment processors, embedded media services, or analytics providers. Third-party cookies are controlled by the relevant third parties and may be subject to their own policies.

Consent records

Consent records may include your consent ID, selected categories, consent status, consent version, policy URLs, consent text hash, IP address, user agent, browser language, page URL, referrer URL, UTM fields, vendor fields, session hash fields, and timestamps such as created, updated, withdrawn, and last seen times.

Changing or withdrawing consent

You can change cookie settings by using Change Cookie Settings, which will show the cookie banner again.

You can also control or delete cookies through your browser settings. Blocking necessary cookies may affect whether some parts of the website work correctly, including account login, checkout, and downloads.

By accessing the website, creating an account, or purchasing digital products, you agree to these terms. If you do not agree with these terms, you should not use the website or purchase digital content.

You agree to use the website lawfully and in a manner that does not damage, disrupt, or interfere with the website, its services, security, or other users.

You must not:

  • Attempt unauthorised access to accounts, systems, or files.
  • Upload malicious software or harmful code.
  • Use automated scraping, bots, or bulk extraction tools without permission.
  • Misuse downloads, accounts, or payment systems.
  • Impersonate another person or provide false information.

petermuscutt.com reserves the right to suspend or restrict access where misuse, abuse, fraud, or breaches of these terms are suspected.

Intellectual property

Unless otherwise stated, all website content remains the intellectual property of Peter Muscutt. This includes photography, music, audio recordings, artwork, graphics, branding, logos, written content, downloadable media, website design, and code.

Content may not be copied, reproduced, redistributed, republished, commercially exploited, or used without prior written permission unless expressly allowed by law.

User accounts

Customers may be required to create an account in order to purchase or access digital products. You are responsible for maintaining the confidentiality of your login details, ensuring your account information is accurate, and all activity carried out under your account.

Accounts must not be shared or transferred. petermuscutt.com reserves the right to suspend or terminate accounts where there is suspected fraud, abuse, unauthorised redistribution of content, or breach of these terms.

Website availability

Reasonable efforts are made to keep the website available and functioning correctly. However, uninterrupted access cannot be guaranteed. Temporary interruptions may occur due to maintenance, hosting issues, software updates, third-party service failures, security measures, or internet connectivity problems.

petermuscutt.com shall not be liable for temporary unavailability beyond reasonable control.

External services and links

The website may use or link to third-party services including payment processors, embedded media providers, analytics tools, or external websites. petermuscutt.com is not responsible for the content, availability, or policies of third-party services. Use of third-party services may also be subject to their own terms and privacy policies.

Limitation of liability

To the fullest extent permitted by law, petermuscutt.com shall not be liable for indirect or consequential losses, loss of data, loss of profits, loss of business opportunity, interruption of service, or compatibility issues with customer hardware or software.

Nothing in these terms excludes liability that cannot legally be excluded under UK law.

Changes to the website or terms

petermuscutt.com may update the website, services, content, or these terms from time to time. Updated terms will take effect once published on the website. Continued use of the website after changes are published constitutes acceptance of the revised terms.

Governing law

These terms are governed by the laws of England and Wales. Any disputes relating to the website or its services shall be subject to the jurisdiction of the courts of England and Wales.

Contact

Questions about these policies or terms should be sent to info@petermuscutt.com.

4. Ecommerce and Digital Download Terms

Digital products

petermuscutt.com sells digital products including, but not limited to, photography downloads, music and audio downloads, sheet music, digital artwork, and downloadable media files. Digital products are delivered electronically only unless otherwise stated.

Product information

Reasonable efforts are made to ensure that product descriptions, previews, and pricing are accurate. However, colours, audio quality, and display appearance may vary depending on device settings, monitors, software, speakers, or internet quality.

Pricing and currency

All prices are displayed in GBP unless otherwise stated. Prices may change without notice. Where applicable, taxes or VAT will be handled in accordance with UK legal requirements.

Payments

Payments are processed securely through Stripe Checkout. petermuscutt.com does not store full card details on its own servers. Orders may remain pending until payment confirmation is successfully received from Stripe through checkout confirmation and/or secure payment webhooks.

If payment is declined, reversed, disputed, or flagged for verification, download access may be delayed, suspended, or cancelled.

Delivery of digital content

Following successful payment confirmation, purchased digital products will normally become available through your account download area. Download access may use secure links, tokens, expiry periods, download limits, or other security controls.

Customers are responsible for downloading and backing up purchased files within any stated access period. petermuscutt.com does not guarantee permanent or unlimited download availability.

Licence and permitted use

All digital products remain the intellectual property of Peter Muscutt unless otherwise stated. Purchases grant a limited, non-exclusive, non-transferable licence for personal use only unless a different licence is explicitly provided.

Unless expressly permitted in writing, customers may not:

  • Resell digital files.
  • Redistribute content.
  • Upload content to file-sharing services.
  • Sublicense content.
  • Commercially exploit the content.
  • Modify or remove copyright notices.
  • Claim ownership of the content.
  • Use the content for AI training datasets or automated scraping.

Commercial use requires prior written permission.

Consumer cancellation rights

Under UK consumer law, consumers normally have a 14-day cancellation right for online purchases. However, where digital content is supplied immediately, this cancellation right may end once download access or streaming begins, provided the customer expressly consents to immediate delivery and acknowledges that the cancellation right is lost once delivery begins.

By completing checkout and requesting immediate access to digital content, you acknowledge and agree that your cancellation right may no longer apply once access or downloading has started. Nothing in these terms affects your statutory rights relating to faulty or misdescribed digital content.

Refund policy

Due to the nature of digital downloads, refunds are generally not provided once digital content has been accessed, downloaded, or made available. Refunds may nevertheless be considered where files are defective or corrupted, the wrong product was supplied, duplicate payments occurred, a technical issue prevents reasonable access, or the product is materially different from its description.

Where appropriate, petermuscutt.com may provide replacement files, restore download access, offer store credit, or issue partial or full refunds. Refund requests should include relevant order details and be submitted within a reasonable time.

Technical issues

Customers are responsible for ensuring they have suitable devices, internet access, software, storage space, and compatible applications required to access downloaded content. Support will be provided where reasonably possible for genuine download or file-access problems.

Fraud, abuse, and chargebacks

petermuscutt.com reserves the right to suspend download access or customer accounts where there is suspected fraud, unauthorised redistribution, abusive download behaviour, chargeback abuse, automated scraping, or breach of these terms.

Unauthorised payment disputes relating to successfully delivered digital content may be investigated and challenged through the relevant payment provider.

Free downloads

Free digital downloads may also be offered through the website. Free downloads remain subject to these terms and any stated licence restrictions unless otherwise specified.

Contact and support

For support relating to downloads, payments, duplicate charges, account access, licensing, or refund requests, please contact info@petermuscutt.com. Please include relevant order information where possible.

5. Physical Goods Terms

Pre-loved and one-off items

petermuscutt.com may list physical goods such as books, musical instruments, amplifiers, accessories, or other pre-loved items. These items are generally one-off listings and may also be advertised elsewhere. Product descriptions will aim to describe condition, included accessories, known faults, and relevant limitations clearly.

Availability

Physical items are subject to availability and may be withdrawn if sold elsewhere, listed in error, or no longer available. If an item is unavailable after an order or enquiry, any payment already taken for that item will be refunded.

Collection

Where collection is offered, the customer may pay the item price through Stripe Checkout and collection will then be arranged. Collection details will be provided after payment or by direct contact. Customers should inspect collected items at handover where reasonably possible.

UK delivery at cost

UK delivery may be available at cost for selected physical items. Where the delivery cost is not known in advance, the website may allow a delivery quote request or reservation before payment. No payment is taken for delivery quote requests until the delivery cost has been confirmed.

Physical goods are currently available for UK delivery only. Non-UK delivery is not offered for physical goods unless agreed separately in writing.

Payment

Payments for physical goods are processed securely through Stripe Checkout. For collection orders, payment may be taken immediately. For delivery quote items, payment will normally wait until the item price and delivery cost have both been confirmed.

Returns and cancellations

Nothing in these terms affects statutory rights. Because many physical items are pre-loved and sold as individually described, customers should read descriptions and condition notes carefully before purchase. If an item is faulty, materially misdescribed, or damaged in delivery, please contact info@petermuscutt.com with the order details.

Contact and support

For questions about collection, UK delivery quotes, condition, payment, or returns for physical items, please contact info@petermuscutt.com.
